TERMS AND CONDITIONS These Terms and Conditions are incorporated into and made a part of the Rental Agreement entered into between GUEST and J2 PROPERTY MANAGEMENT INC. (hereinafter \`Florida Spirit\`). 1\. Nature of Use. Guest is hereby granted a license to use the Premises. Guest acknowledges and agrees that no form of tenancy has been created pursuant to Chapter 83, Florida Statutes through Guest\`s use of the Premises. 2\. Age Requirement. Guests under the age of 18 unaccompanied by a parent or legal guardian will not be permitted to rent or occupy any vacation rental home from Florida Spirit. Any reservations made under false pretenses will result in loss of advance payments and removal from the premises. 3\. Agency of Florida Spirit. Guest acknowledges and agrees that Florida Spirit acts as agent on behalf of the owner of the subject vacation property (the \`Premises\`) for the purpose of reserving, renting and managing the use of the Premises. 4\. Prohibited Uses. Only Guest and persons identified in the Rental Agreement as a Guest party may use or occupy any part of the Premises. Guests may not invite other persons to make use of the Premises or the amenities related to such Premises for any reason whatsoever. Smoking is not permitted in any part of the Premises. Failure to comply with Florida Spirit’s non-smoking policy will result in a $75 charge to the credit card on file. Grills should only be used on the lawn outside of the pool screen, and not inside any other part of the Premises including, without limitation, inside the house, in the garage, or on the pool deck. Guests are solely responsible for using appropriate safety precautions in using grills on the Premises, and shall be liable for all damage resulting from misuse of any grill. Parents are solely responsible for supervising their children on the Premises, including the pool, if applicable. Adult supervision is required at all times when children are using the pool. Renters must be 18 years of age and hold a major credit card (not debit card) in their name. 5\. Pets. Guest acknowledges that NO PETS or animals of any nature are permitted on the Premises, unless the reservation and Florida Spirit has expressly authorized such use. Some homes are Pet Friendly (DOGS ONLY, maximum 2) and require a non-refundable Pet Fee of $150.00 and $250 Refundable Pet Deposit that is refunded after departure if there are no damages caused from the pet. If pets or animals are found to be occupying the Premises without authorization, Guest will be subject to all other rights and remedies of Florida Spirit for violation of these Terms and Conditions, and in addition a $500 cleaning fee will be charged to the credit card on file. 6\. Check In/Check Out. Check in at the home is after 4:00 p.m. and check out from the home is before 10:00 a.m. Use last four digits of booking number to access your home during your stay dates. Guest may proceed directly to the Premises for check in. Guests are requested to lock the home behind them on day of departure. Failure to depart by 10:00 am may result in a $75.00 charge to the credit card on file. 7\. Right to Refuse Occupancy and Removal of Guest. If Guest violates the terms and conditions of occupancy of the Premises, including without limitation, failure to pay rent as agreed with Florida Spirit, failure to check out of the Premises at the time set forth herein (or if such time is extended at Florida Spirit\`s sole option, at the time otherwise agreed to by Guest and Florida Spirit in writing), causing damage to the Premises, or engaging in prohibited use of the Premises, and Guest fails to pay for, or vacate the Premises upon written or oral request by Florida Spirit, Guest may be summarily removed with the assistance of a Florida law enforcement officer in compliance with Section 509.141(4), Florida Statutes. In addition, in the case of a large unpaid bill for rental of the Premises where Florida Spirit reasonably determines that such an unpaid bill may not be paid by Guest, Florida Spirit may elect, in addition to all other remedies available to Florida Spirit, to lock Guest out of the Premises until payment arrangements are made in accordance with Section 509.401, Florida Statutes. In the event a guest fails to depart from the home on time at 10:00 am, forcing Florida Spirit not to be able to clean and prepare the home for the next arriving guest that day and having to move that guest to another home, the departing guest agrees to pay damages and cost incurred by Florida Spirit. Florida Spirit reserves the right to refuse service to any guest for any reason, provided, however, that such refusal shall not be based on race, creed, color, sex, physical disability or national origin. 8\. Comparable Premises and Force Majeure. Unforeseeable circumstances may arise which make it impossible or impractical for Florida Spirit to provide the anticipated accommodations to Guest. Such circumstances may include, but not be limited to, scheduling problems, equipment failure, as well as a fire or other casualty at the Premises. In such a circumstance, Florida Spirit reserves the right to transfer Guest to another vacation property of reasonably comparable value, determined in the sole discretion of Florida Spirit, whose determination shall be final. In other circumstances such as acts of God, acts of war, acts of terrorism, hurricanes, wind storms, fires or other natural occurrences, said circumstances not being exclusive, it may be impossible or impractical for Florida Spirit to make available reasonable or other alternative accommodations to Guest. In such a circumstance, Florida Spirit shall return 100% of the payments received by Guest. 9\. Furnishing and Linens. Furnishings of the Premises are subject to change without notice. Furniture, bedding, utensils or any other property supplied with the Premises must not be taken out or transferred from one property or another. Loss of these items, as well as damage to the property or furnishings in excess of normal wear will be charged to the Guest. Moving of furnishing inside, outside, or in the game room of the Premises is strictly forbidden. If any furnishings need to be moved back to original placement, there is a $125.00 per hour charge to the Guest. A basic supply of linens is provided in each property. We wanted to get as close to Daytona international speedway. This was as close as we could get at a last minute request. This was a good stopping place for us. Only one hour away. The pool and spa were a bit cooler than we expected but it didn’t stop us from spending time in there. We had everything we needed for meals and entertainment. My only suggestion would be to put stickers on the patio doors as they were so clean one of our little ones ran into them going to the pool. We picked up some from the dollar store for our stay. It is huge and clean. House is in a great location. The property was nice. Office hours is only from 9-5 Downfalls All the bath towels were stained, flies took over the pool daily, the number you are provided is not a direct line. No net to clean the pool. No one answers and they respond the next day. Worse thing ever happened my parents were in bed while we took the kids to Disney and housekeeping busted in the house practically accusing them of being squatters. I started calling and emailing every number I had to get answers. No one called me back until the next day. Almost 24 hours later, owner hasn’t called me back, operations hasn’t returned my calls and my parents are still shaken up. ##### Latorya L. The only downfall is the pool and jacuzzi. Neither was heated. However, maintenance did come very soon but was unable to fix the issue. We still appreciated the urgency in the attempt. The mattress in the master bedroom downstairs killed my back because it’s so worn it just sinks down and you have a tough time getting out. The hot tub didn’t work for several days but after a lot of back and forth with Florida spirit homes and several workers it finally just began working on Tuesday night. Worker said it was a short???? Internet is spotty and we couldn’t always get things to download on our tablets but we weren’t there to play online. Pool got a lot of use. Cleaners came on Tuesday as well for that. Minimal cookware if you plan to eat in which we did often so we ended up buying an extra pot and leaving it. Plenty of dishware and silverware and dishwasher worked like a champ. We bought dishwasher detergent and laundry detergent since home supply is only a starter kit of one packet. We also bought spray cleaner for countertops as there are no cleaning supplies there and kids ate at counter a lot. Coffee maker is old school mr. coffee type but works well-just a pain when everyone drinks something different. We left behind a box of filters as there are none offered with pot. Being realistic we bought a lot of stuff for our stay at this house to be comfortable but it’s not a hotel so kind of expected some things would need to be bought. Neighborhood is cookie cutter houses all the same and very tightly packed together-we could talk with the next door rental neighbors while we sat in our respective pools. There is a security vehicle driving around since with lights swirling we were shocked to find them at our door when one of the kids left the car door open and at night the light was on. Thankful for that notification however the several nights that the people behind us and then off to the other side of the street partied all night screaming and yelling we never saw a security vehicle. The clubhouse was great to take the kids to across the street from the gated community-you could walk it but we drove with toddlers, teens and equipment. Small lazy River that only has a few floating rings available was great for all of us- we bought 4 rings and a beach ball at Walmart for under $20 and left at the house for others as well. The drinks at the little cafe window were awful-mixes that tasted cheap but cost a lot. Food offerings were minimal but there was a freezer in the lobby with ice cream options. A small arcade was nice for the kids. ##### jackie w. Had to call 2 days in a row for issues in the property. Issues with wifi, bed frame in one of the bedrooms that I was told was going to be changed, we had to replenish the toilet paper and paper towel. If not you get charges and no stains of any kind on any of the towels. I have stayed in resorts and that diest happen. For the price I paid to stay yea that should not happen. Just a couple of issue we requested the pool be heated and received a email the day before stating that during inspection it wasn’t working properly. Was given have our money back and a complimentary grill which did it arrived prior to the rental but 2 days later and we didn’t even use it. The carpet has stains throughout the home ,maybe could have got a couple of runners to cover it up. Also the refrigerator didn’t seem to stay cold and the ice maker doesn’t seem like it was working properly. The fridge in the garage workers very well. ##### LaShaunda T. I do have to complain about all of the marks on the walls. It also looks like someone changed the oil from their vehicle in ever room that had carpet, because of all of the black marks. We did pay for the hot tub to be hot but it was not working. I was given a refund, which was very nice of them to get it back to me. The houses are very close together and there is no extra parking. You also have a hard time driving thru the division with so many cars parked on the street. There is also quite the line to get thru the gate when trying to enter the division. Next time i will be picking a house in a different resort. ##### Crystal L. WiFi went in and out so it was hard for kids to do their online school work. Water in Master bath needs a booster tank to get hotter water to the shower. With 9 bedrooms & 6 baths, our family of 16 had plenty of room to both spend time together & still be able to get away for some alone time too. Our family agreed that we definitely would return to this house when we have a large group again. We visited in early-to-mid March and we couldn't believe how hot the water in the hottub got. It was amazing on the cooler nights. The only downside was it seemed that this house had more rules about what cleaning the guests need to do before leaving. For instance the guests must wash & put all dishes and cookware in the cupboards. When everyone is trying to eat & pack-up suitcases before leaving by 11am, having to wash & put-away dishes gets a little hectic. However, it wasn't that big of a deal, and we managed to get it done and would absolutely still rent this house again. ##### Sandy M. It was in a neighborhood so it was nice and quiet but close enough to all the attractions to not take very long to get there. The house was perfect size for our large family and it was a very clean.
