"The Expedia.ca Great Escape Holiday Contest "

Rules and Regulations

 

 

1. TO ENTER: No purchase necessary.  Entrants can enter on-line at www.expedia.ca  or www.expedia.ca/promos.  Entrants must be a registered member of Expedia.ca to enter the contest (registration is free).  Follow the on-line instructions to complete and submit your entry form (which must include your full name, complete mailing address, area code/phone number, and email address). Online entries shall be deemed to be submitted by the holder of the email account from which they were sent. Entries are limited to one per person.  Illegible entries, bulk drop-offs or mechanical reproductions or facsimile entries are ineligible. Contest starts on September 17th, 2003, and entry deadline for the contest will be 11:59 p.m. Eastern Daylight Time, on October 12th, 2003 (the "Contest Closing Date"). Contest open to residents of Canada (excluding Quebec residents) who have reached the age of majority in the province in which they reside at the time of entry.  Proof of identification must be provided upon request. Employees of Expedia Canada Corp. (the "Contest Sponsor")  or of any of its affiliates and its and their advertising and promotional agencies and the immediate family of such employees and persons with whom such employees are domiciled are ineligible.  "Immediate family" means parents, siblings, children and spouse.

 

 

 

2. GRAND PRIZE: There will be one (1) Grand Prize for one (1) winner, consisting of accommodation and return trip for two (2) to the following property:

 

- Mosquito Blue Resort, Mayan Riviera, Mexico

 

 

Trip to Mayan Riviera includes: round trip economy airfare for two (2) from the major Canadian gateway closest to the Grand Prize Winner's place of residence in Canada (hereinafter referred to as the "Departure Point"); 7 nights accommodation (based on one room, double occupancy), at the applicable resort during the stay.  Transportation to and from the Departure Point, and to and from the Mosquito Blue Resort, are the sole responsibility of the Grand Prize Winner and their guest.  Approximate retail value of this Grand Prize is four thousand and five hundred Dollars Canadian ($4500 CDN) based on a Vancouver departure.  Certain blackout periods apply.

 

Costs and expenses incurred by the winner and/or his/her guest in claiming or using the prizes and which are not outlined in this prizes description are the sole responsibility of the Grand Prize Winner and  his/her guest and may include applicable taxes, ground transportation, airport departure taxes, off-site meals and beverages, bar and wine charges, room service, gratuities, merchandise, souvenirs, local and long distance telephone calls, medical and travel insurance together with any required travel documentation, and all personal expenses of any kind or nature, together with any applicable overnight layover.  The Grand Prize Winner and  his/her guest are also solely responsible for all costs incurred to and from the Departure Point as the Grand Prize originates and terminates there.  All travel arrangements and bookings must be made through the Contest Sponsor and the Grand Prize Winner must provide the Contest Sponsor with at least three (3)  weeks prior notice before the proposed departure date. Travel must be completed by a date to be determined by Expedia.ca and certain blackout periods apply. Grand Prize Winner and  his/her guest must have reached the age of majority in the province in which they reside as of Contest Start Date.  The Winner and  his/her travel companion must travel on the identical itinerary. Travel for the Grand Prize Winner and  his/her guest must originate from and end at the same airport. The Grand Prize Winner and  his/her guest may be required to provide appropriate government issued photo identification (such as a valid passport) at time of travel. The Grand Prize Winner and  his/her guest are solely responsible for determining and obtaining all necessary travel documents and other travel requirements. No changes will be made to travel details once any portion of travel arrangements have been made, except at the Contest Sponsor's sole discretion. The Contest Sponsor is not responsible for changes in schedule of any element of the Grand Prize, and is not liable for any expenses incurred as a consequence of flight cancellation/delay.

 

 

3. Grand Prize must be accepted as awarded. The Prize may not be sold, transferred and is not convertible to cash. The Grand Prize may not be used towards any type of frequent flyer mileage accumulation program.  Booking is subject to 100% cancellation penalties and cancellation insurance is not available.  Contest Sponsor reserves the right to substitute the Prize in whole or in part in the event that any component of  the Prize is unavailable.

 

4. On or soon after October 17th, 2003 (the “Contest Draw Date”), a random draw will take place from all eligible entries received from entrants residing in Canada (excluding Quebec) and one (1)  entry will be randomly selected. The odds of winning the Grand Prize will depend upon the total number of eligible entries received on or before the Contest Closing Date.   The Contest Sponsor will attempt to contact the selected entrant after the draw by telephone.  In order to win, the selected entrant must correctly answer, unaided, a time limited mathematical skill testing question. In the event that a selected entrant is disqualified from eligibility, does not otherwise comply with these contest rules, does not correctly answer the mathematical skill testing question within the time limit or cannot be contacted by the Contest Sponsor within two (2) business days after the Contest Draw Date, Contest Sponsor shall have the right to redraw another entrant to be eligible to win.  The Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard. By entering this contest, the entrants automatically agree to accept and abide by these contest rules and regulations.

 

5. All entries become the property of Contest Sponsor who may not be held liable for and who assumes no responsibility for (i) late, lost, delayed, not received, damaged, misdirected, incomplete, stolen, fraudulent or illegible entries (all of which entries shall be automatically void and not eligible for a prize); (ii) failure to receive entries due to transmission failures, busy signals, traffic congestion on the internet or at any website or technical failures of any kind, including, without limitation, malfunctioning of any network, servers, access providers, hardware or software, whether originating with sender or recipient, or (iii) any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in this contest and breaches of privacy due to interference by third party computer "hackers".  No correspondence will be entered into except with the selected winning entrant. Contest Sponsor shall not be held responsible for any errors, negligence, losses or damages that may arise or occur in connection with the contest. Contest Sponsor also does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof.  Entry materials/data that have been tampered with or altered are void. Contest Sponsor reserves the right to cancel or modify the contest if, in its sole discretion, it determines that the contest is not capable of running as originally planned for any reason (such as tampering or infection by computer virus, fraud, technical failures, printing or distribution errors, or any other causes or occurrences have compromised the fairness or integrity of the contest). All decisions of the Contest Sponsor are final in all matters as they relate to this contest.

 

 

6. The Grand Prize Winner and  his/her guest must authorize the Contest Sponsor and its affiliates and their respective representatives to broadcast, publish and disseminate their names, addresses, photographs, likenesses and voices, in connection with any promotion or publicity (worldwide in any form including the internet), and/or for general news and information purposes at no compensation to the Winner and/or their guests.  Prior to being awarded the prize, the Grand Prize Winner and his/her guest must sign and return within forty-eight (48) hours of receipt a standard release  agreeing to abide by these contest rules and regulations, confirming acceptance of the prize as awarded and releasing the Contest Sponsor (and its affiliates) from any and all claims or liabilities arising out of any matter related to  this contest and the prize.  This contest is subject to all applicable Federal, Provincial and Municipal laws.  The Contest Sponsor reserves the right to withdraw, amend or terminate this contest at any time without prior notice.

 

7. By completing the entry form all entrants consent to the collection, use and distribution of their personal information by the Contest Sponsor for the purposes of running the contest. Contest Sponsor will not sell or transmit this requested information to third parties.
